A common misconception is that Initiative 81 established a licensed retail dispensary framework. It did not create commercial retail licenses for entheogens. Direct OTC cash sales of psilocybin or entheogens remain unauthorized under District statute.
To comply with local regulations while sharing access, the District operates under a community gifting framework (similar to D.C.'s established Initiative 71 art-gifting culture):
Supporting Independent Art & Creators: Patrons purchase physical merchandise, souvenirs, or digital artwork directly from the
Lumumba Beach Digital Art Collection
Complimentary Gifting:
With an eligible art or merchandise purchase, patrons may receive an optional, curated entheogenic gift.
No Direct Commercial Transactions for Entheogens:
The commercial transaction is strictly for the art and creative goods produced by our community.
Critical District Boundaries & Legal Rules
To ensure a safe and compliant experience, all community members must observe District boundaries and jurisdictional restrictions:
Strictly Within Washington, D.C. Borders: Gifting and possession are only recognized within the District of Columbia.
Transporting entheogens across state lines into Virginia or Maryland is a violation of state and federal law.
Federal Property Prohibitions: Approximately 20% of Washington, D.C. land is under federal jurisdiction. Entheogens remain strictly prohibited on all federal property, including the National Mall, monuments, memorial grounds, Rock Creek Park, military installations, embassies, and federal office complexes.
Private Property Only:
Possession and consumption must take place in private residences or private spaces with property owner permission. Public consumption on D.C. streets, sidewalks, or parks is prohibited.
